Terms of Service

The service

MerQuery is a cloud-based SaaS product that connects to a business's Facebook Page and replies to customer messages on Messenger using an AI chatbot grounded in a knowledge base you provide. It can also extract lead information, take product orders, and book appointments through the conversation, depending on your plan and configuration. MerQuery discloses to customers that they're talking to an automated assistant, and provides a way to reach a human — this disclosure and handoff path can't be disabled.

Accounts and eligibility

You must be authorized to act on behalf of the business and Facebook Page you connect. You're responsible for the accuracy of the knowledge base and business information you provide, and for keeping your account credentials secure. We may suspend or terminate an account we reasonably believe is being used fraudulently, abusively, or in violation of these Terms.

Subscriptions and billing

Paid plans, pricing, and usage limits are described on our pricing page. New accounts start on a free 14-day trial (up to 10 conversations, 1 connected Facebook Page) and can upgrade at any time. Fees are billed in advance per billing period and are non-refundable — see our No-Refund Policy for details, including how to cancel.

Acceptable use

• · Don't use MerQuery to send spam, unsolicited, or deceptive messages.
• · Don't use it for content that's illegal, hateful, or violates Meta's own Platform Terms and Community Standards — your use of Messenger through MerQuery is also bound by Meta's policies.
• · Don't attempt to disable, misrepresent, or hide the automated-assistant disclosure or human-handoff path.
• · Don't attempt to interfere with or reverse-engineer the service, or use it to build a competing product.

We may suspend access for use that violates this section or puts the service, other tenants, or our Meta platform access at risk.

Your content and data

You retain ownership of your knowledge base content and business data. You grant us a license to use it solely to operate the service on your behalf — generating replies, extracting leads, and populating your dashboard. AI-generated replies

Replies are generated by an AI model grounded in the knowledge base you provide. We work to keep replies accurate and on-topic, but AI-generated content can be wrong or incomplete. You're responsible for reviewing your knowledge base for accuracy and for monitoring conversations — especially anything involving pricing, availability, appointments, or commitments made to a customer.

Third-party platforms

MerQuery depends on Meta's Messenger Platform and Facebook Login to operate, and on Google's Gemini API to generate replies. We're not responsible for outages, policy changes, or access restrictions imposed by these third parties that are outside our control.

Disclaimer and limitation of liability

MerQuery is provided "as is," without warranties of any kind. To the maximum extent permitted by law, MerQuery IT Solutions isn't liable for indirect, incidental, or consequential damages arising from your use of the service, including lost sales, lost data, or reliance on an AI-generated reply. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.

Termination

You can stop using MerQuery and request account deletion at any time (see Data Deletion). We may suspend or terminate your access for violating these Terms, non-payment, or if required by Meta or another platform we depend on.

Changes to these Terms

We may update these Terms as the service evolves. We'll update the "Last updated" date above when we do; continued use after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of MerQuery will be subject to the exclusive jurisdiction of the courts of the Philippines.
